Good bye, Triple Talaq!

New Delhi: In a historic development, the Supreme Court has called for the suspension of the Islamic practice of Triple Talaq for Six Months. Subsequently, the Apex court has also directed the government in centre to draft a law on Triple Talaq in the same time period. However, three out of five Judges of the Bench headed by Chief Justice JS Khehar have termed the practice unconstitutional. The other four judges on the Bench included Kurien Joseph, RF Nariman, UU Lalit and S Abdul Nazeer.The verdict came after the six-day marathon hearing during the summer vacation, the Bench had reserved its ruling.

Earlier, the apex court had heard seven petitions filed by Muslim women, challenging the validity of Triple Talaq, in which husband divorces wife by pronouncing the word ‘talaq’ thrice in one go. The Centre in its response to the court had said that it would frame a law to regulate marriage and divorce among Muslims if the court finds ‘Triple Talaq’ invalid and unconstitutional. The Supreme Court had clarified during the hearing that it would limit the scope of deliberations only to examining as to whether allowing triple talaq was part of an ‘enforceable’ fundamental right to practice religion by the Muslim community, and may not deliberate on polygamy.
