Earlier today the President's office had issued a notice stating that Deuba has been appointed the PM as per the Supreme Court's Monday verdict. However, to the surprise of many the notice did not reveal the Article under which the appointment was being made.

The Supreme Court in it's order had specified that Deuba would be made the PM in accordance with Article 76 (5) of the Constitution.Deuba had made it clear to the President that he will not take the oath unless the notice is rectified and the article specified.

Bhandari agreed to Deuba's terms and appointed him pursuant to the aforementioned article.Deuba, who has earlier served four terms as Nepal's PM will now have to gain the trust of House of Representatives within 30 days, as provisioned by the Constitution

Yesterday, the Supreme Court ordered that the House of Representatives be reinstated and directed the President to appoint Mr Deuba as new prime minister on Tuesday.

The five-member Constitutional Bench led by Chief Justice Cholendra Shumsher Rana said that Mr Oli's claim to the post of prime minister was unconstitutional.

The house was dissolved on May 22 by President Bhandari over the recommendation of Prime Minister KP Sharma Oli, but it was challenged by an alliance of the opposition parties and others at the Supreme Court.

Deuba had served as Nepal's Prime Minister from June 2017–February 2018, June 2004–February 2005, July 2001–October 2002 and September 1995–March 1997.

Deuba will have to win a vote of confidence from the House within 30 days of his appointment as the Prime Minister, as per constitutional norms.

Earlier, Nepali Congress President Sher Bahadur Deuba, who was appointed as Prime Minister of the Himalyan nation by President Bidya Devi Bhandari, said he will not take oath of office until office of President revises its notice of appointment issued to him on Tuesday.

The notice, which read that Mr Deuba is being appointed in accordance with the Supreme Court's verdict, 'fails to disclose' the article under which he is being made the prime minister, The Himalyan Times reported.

After deliberating with legal counsel, Mr Deuba had sent across a message to President Bhandari that he will not take the oath until the error is rectified.(UNI)
