A Pocso court in Dehradun sentenced a 30-year-old woman to 20 years of rigorous imprisonment (RI) after finding her guilty of sexually assaulting her 16-year-old step-nephew in 2022. Pocso court judge Archana Sagar has also imposed a fine of her Rs. 10,000 on the convict.
Prosecution counsel Alpana Thapa said, “the boy's mother filed an FIR against the convict at Vasant Vihar police station in Dehradun on July 5, 2022. In the FIR, she said that her sister-in-law shifted to their house in 2021 after "discord" with her husband. She made physical relationship with her son for months, few days ago she eloped with her teenage son and when they returned, she was pregnant. She had four children and is her husband's step-sister.”
“Police acted on the FIR and arrested the accused aunt on July 9, 2022,” Thapa added.
She was granted bail on January 2, 2023 and then she gave birth to a baby girl.
The prosecution presented the forensic scientific lab report which confirmed the boy as the "newborn's biological father".
However, the boy retracted his allegations in the court. He said that he had consensual relations with his aunt.
But, the victim was a teenager and the aunt was several years older than him. In such a situation, the court considered the incident as sexual assault on the teenager on the basis of DNA test report and age. The woman was found guilty and sentenced to 20 years of rigorous imprisonment. The court sent the woman to the jail.
