New Delhi: A Delhi court, after hearing the submission in Delhi Chief Secretary Anshu Prakash's assault case, on Thursday granted bail to Delhi Chief Minister Arvind Kejriwal, Deputy Chief Minister Manish Sisodia and 11 other Aam Aadmi Party MLAs who were accused in the case.
Police had registered a case on the complaint of Anshu Parkash who alleged that he was assaulted by AAP MLAs on the intervening night of February 19 and 20 at Kejriwal's residence, when Prakash was called there for a meeting.
After investigation, Police filed chargesheet under sections 186 (obstructing a public servant), 323 (voluntarily causing hurt), 332 (voluntarily causing hurt to deter public servant for doing his duty), 342 (punishment for wrongful confinement), 353 (assault or criminal force to deter public servant to discharge his duties), 504 (insult with intent to provoke breach of peace), 506(ii), 120B (criminal conspiracy), 109 (punishment of abetment if the act abetted is committed in consequence and where no express is made for its punishment), 114 (abettor present when offence is committed),149 (unlawful assembly) 34 (common intention) and 36 (effect caused partly by act and partly by omission) against the accused person.
Additional Chief Metropolitan Magistrate Samar Vishal took cognizance on the chargesheet filed by police and issued summons against Amanatullah Khan, Prakash Jarwal, Nitin Tyagi, Rituraj Govind, Sanjeev Jha, Ajay Dutt, Rajesh Rishi, Rajesh Gupta, Madan Lal, Parveen Kumar and Dinesh Mohania apart from Arvind Kejriwal and Manish Sisodia to appear before the court.
The Magistrate passed an order to grant bail to all the accused persons with the conditions that they will submit bail bond of Rs 50,000 each in the court. The court put the further conditions that all the accused AAP MLAs would be present for further hearings in the case and will not try to tamper with the evidence or to influence the witnesses in the matter.
The court further directed that the accused AAP leaders cannot travel out of the country without the permission of the court. However the court has restricted the movement of Kejriwal and Sisodia. They have been ordered to seek permission from the court before leaving Delhi.
The court directed the Naib Court to supply the copy of chargesheet to all the accused persons for scrutiny of the documents and adjourned the matter for December 7 for further proceedings.
