New Delhi: Lawyer appearing for one of the petitioners, told the Supreme Court on Monday that it was not in record as to what treatment was provided to Special CBI Judge BH Loya, who died in mysterious circumstances, in the hospital. V Giri, lawyer appearing for petitioner Tehseen Poonawala, told the three-judge bench of the Apex Court, headed by Chief Justice of India (CJI) Dipak Misra that as per the witnesses and documents available, three persons were present during his treatment. There is a contradiction in the post mortem report of Judge Loya, Giri further told the Apex Court.
Giri further submitted to the Apex Court that the death was mysterious and it should be investigated by the Special Investigation Team (SIT). Senior advocate Giri referred to computer generated bill of the hospital which refers Neuro surgery bill contrary to the fact that Judge Loya who had suffered heart attack.
The Apex Court would now hear the matter on February 9, Friday. During the course of the arguments, there was a heated exchange of words between Dushyant Dave and judges. "Dont teach us about out conscience", Justice Chandrachud told Dave, when Dave did not listen and constantly spoke about his submissions.
The three petitioners - Anitha Shenoy, Tehseen Poonawala and a journalist, Bandhuraj Sambhaji Lone - had knocked the doors of the Apex Court and had alleged that Judge Loya had allegedly died in a very suspicious and mysterious circumstance in December 2014 while hearing the case in which Amit Shah then was an accused in the alleged Sohrabuddin Sheikh fake encounter case. The three petitioners also sought a SIT probe into the alleged and mysterious death of Judge Loya. The Apex Court asked all the parties to file their respective whatever documents relating to Judge Loya's death. (UNI)
