Nirbhaya case: SC nixes Mukesh’s plea challenging President’s rejection of mercy petition

New Delhi: The Supreme Court on Wednesday turned down the petition filed by one of the Nirbhaya case death row convicts, Mukesh Kumar Singh, against rejection of his mercy plea by the President.

A three-judge bench of the Apex Court, headed by Justice R Banumathi, said, “All  the relevant documents and material  of the case were placed before  the President, who took all relevant records into account before  dismissing the mercy plea.”

On Mukesh being tortured inside the prison, the Apex Court, said, this can’t be a ground to review the President’s order.

“Alleged sufferings in jail can’t be grounds to challenge the rejection of mercy plea by President,” the court added.

On the speed with which Mukesh’s plea was dismissed, the Apex Court said, quick consideration does not mean no application of mind.

On Tuesday, the court had heard in detail the arguments and submissions by Mukesh and from prosecution side.

The convict had prayed to the Apex Court that President had not applied his mind while rejecting his mercy petition.

The prosecution said that the President had taken every aspect into consideration while rejecting the mercy petition. (UNI)
