Allahbad HC: Triple Talaq is unconstitutional; cruelty to women

Allahabad: In another setback for the institutions supporting the ''triple talaq'', Allahabad High Court today ruled that "No Personal Law Board is above the Constitution" and triple talaq is cruelty on women. The verdict was given by Justice Sunit Kumar, on two petitions filed in the court over the triple talaq issue.
 

The court maintained that "triple talaq is unconstitutional, it violates the rights of Muslim women" and hence it cannot be above the Constitution. The judgement of the court comes in wake of a similar case underway in the Supreme Court where the All India Muslim Personal Law Board (AIMPLB) has supported the triple talaq issue while the Central government had opposed it. AIMPLB had said that there was no scope of change in the 'triple talaq' system.

It had also rejected the suggestion by some Muslim outfits to build a consensus on making a three-month 'notice period' mandatory before finalization of divorce. In 1986, the Rajiv Gandhi government passed a law to overturn the Supreme Court's Shah Bano verdict that had granted Muslim women lifelong alimony rights with conditions. (UNI)
