Second wife not entitled to family pension: HP High Court

Hamirpur/Shimla: Judge Jyotsna Riwal Dua of HP High court has ruled in her judgment that the second wife is not entitled to family pension under any circumstances.

Dismissing the petition of Durgi Devi, a resident of Bilaspur, the court pronounced this decision.

It’s notable here that Late Bhola Ram retired from the police department in 1983. He died in 2002. Bhola Ram had got his second wife registered in the government records for family pension.

However, the first wife Ramku Devi claimed the family pension with the department.

After investigation into the matter, the department found that Ramku Devi was the first and legally married wife of Bhola Ram. On this basis the family pension was sanctioned and paid to her. Ramku Devi also died on August 1, 2015.

The petitioner had contended that after the death of the first wife, there was no other claimant for family pension except her. After perusing the records relating to the case, the court observed that the deceased had married the petitioner during the subsistence of the first marriage. The petitioner cannot be held entitled to family pension as second wife. (UNI)
