SC refuses to entertain petition seeking marital rape as basis for divorce

New Delhi: The Supreme Court on Monday refused to entertain the petition filed by woman lawyer, Anuja Kapur, seeking a direction to the Union of India (UOI) that it should frame the necessary guidelines related to marital rape as a ground of divorce.

“There is no merit in the petition of the petitioner. We are not inclined to hear this petition,” the bench of the apex court, headed by Justice SA Bobde and Justice BR Gavai passed  the order and refused to entertain the petition of Anuja Kapur.

The top court, however, granted Anuja Kapur, the liberty to approach the Delhi High court for seeking relief in the case.

The petition was filed before the Supreme Court by lawyer, Anuja Kapur, seeking a direction to the central government to ensure that there should be a clear guideline for registration of the cases related to marital rape under framed guidelines and laws. (UNI)
